Below are the facts, which we see as irrefutable, and lead us to a NO vote after reading the 129-page draft (Not final contract) released by SAG/AFTRA.
1 The deal is a draft – not final – Who ever signed any legal document without final language ???
We should have final language before execution (before the vote is due) like every legal doc. Would you buy a house, sign a house loan, sign your estate planning, sign any acting deal without final language?
2 AI
A) SAG is a guild for live human performers. Period. This is THE MOMENT. We have the bargaining power now even if they say we don’t. The DGA and Writer’s Guild put protections in place that this contract does not have. The DGA deal stipulates that duties performed by DGA members must be assigned to a person, notes that the AI does not constitute a person. The Writers Guild deal bans AI-written or rewritten literary material, “AI-generated material can’t be used to undermine a writer’s credit or separated rights.” We need to do the same. Studios/ Producers need actors now, but if we sign this, they will not. (This is like Blockbuster, DVD and New Media but more catastrophic.)
B) AI nullifies the Salary Minimums, Residuals and Pension & Health payments – even if you like the numbers in this deal (which I personally don’t – look at top of show guest star roles etc,) we will not get this money. It is a Catch 22.
The compensation for use of your likeness in perpetuity even after death is ludicrous/ minuscule and in a number of instances the compensation is non-existent.
They can hire you for digital replica on same day working for no other compensation and use you for an infinite number of scenes. How does this not put us out of work?
The stipulated rates for when not already working are, “One (1) day at performer’s prorate daily salary, but not less than day performer minimum one half (1⁄2) of the performer’s pro rata daily salary is due for a four (4) hour session.” How can hiring us for 4 hours instead of using us on set (we are never hired for a half day) not put us out of work? | Posted on 27/Nov/2023 01:21:58
