Katie Couric Instagram – 🚨In a historic decision, the Colorado Supreme Court ruled that former President Donald Trump is not an eligible presidential candidate because of the 14th Amendment’s “insurrectionist ban.” The ruling was 4-3 and will be placed on hold pending appeal until January 4.
In a lengthy ruling ordering the Colorado Secretary of State to exclude Trump from the state’s Republican primary ballot, the justices reversed a Denver district judge’s finding last month that Section 3 of the 14th Amendment — which disqualifies people who have engaged in insurrection against the Constitution after having taken an oath to support it from holding office — did not apply to the presidency.
“A majority of the court holds that President Trump is disqualified from holding the office of president under Section Three of the Fourteenth Amendment to the United States Constitution,” the court wrote. “We do not reach these conclusions lightly,” the statement continued. “We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach.”
The decision is certain to be appealed to the US Supreme Court, but it will be up to the justices to decide whether or take the case.
