Below are the facts, which we see as irrefutable, and lead us to a NO vote after reading the 129-page draft (Not final contract) released by SAG/AFTRA.
“The Producer determines the number of production days that the performer would have been required to work had the performer instead performed those scene(s) in person. The Producer will make a good faith effort to estimate the number of production days.” There are a lot of clauses where the producers will act in “Good Faith.”
Another one: “The Producer agrees to give the Union notice and an opportunity to bargain in good faith over appropriate consideration, if any, if a Synthetic Performer is used in place of a performer who would have been engaged under this Agreement in a human role.” This verbiage gives us nothing. Don’t forget these people who will be negotiating in good faith are the people making multi-million-dollar salaries, who said that they were fine with people losing their houses, have lied for years claiming they’ve made no profit and have never showed accounting. (More on profits later.)
Even SAG admitted they were played by the Producers with giving them the extension – there was no good faith negotiation. It allowed them to release some of their Blockbuster movies and generate a lot of money. These are the same people paying lots of money to cut down trees, put up barricades to impede strikers and hire expensive PR firms rather than pay actors. But we should trust all these vague clauses will be negotiated in good faith.
C) Another concerning element in this draft: “If performer is deceased, the Producer shall obtain the consent of the authorized representative (or the Union, if the deceased performer’s authorized representative cannot be identified or located) who represents the deceased performer’s exclusive rights as determined by applicable law.” Why should the Union have this ability? Are they now acting as an agency? Do they get money for this? I personally do not want SAG to have that power over my likeness / identity/ my work after I die. | Posted on 27/Nov/2023 01:30:23
